About

Pavel is counsel in the Astana office of White & Case. He focuses on international arbitration, litigation and insolvency proceedings. Pavel has experience in international commercial and investor-state arbitrations involving CIS countries and is on the lists of International Arbitrators of HKIAC, the International Arbitration Center of the Astana International Financial Center (AIFC), the Arbitration Center of the Russian Union of Industrialists and Entrepreneurs (RSPP), and the Russian Arbitration Center (RAC) at the Russian Institute of Modern Arbitration.

He also represents companies in proceedings before Russian commercial courts in various regions and at all levels, in a wide range of construction, finance, corporate and other business-related, often multijurisdictional disputes. Pavel regularly advises on conflicts of laws, as well as jurisdictional and enforcement issues, and acts as expert on Russian law in non-Russian court proceedings.
Pavel actively participates in the working group of the Interparliamentary Assembly of CIS Member States on the preparation of a draft model law “On Cross-Border Insolvency and Bankruptcy.”
Pavel also has significant expertise in domestic and cross-border insolvency proceedings and represented creditors, debtors and administrators in large bankruptcy cases. He is frequently published in legal journals and is a sought-after speaker at many landmark legal conferences

Notable Cases

  • Representation of Dekhkanabad Potash Plant, the leading Uzbekistan-based potash fertiliser producer in Central Asia, in connection with the related US$32 million ICAC arbitration proceedings, and representing, on a pro bono basis, over 200 individual Uzbek workers claiming unpaid salaries from the insolvent Russian contractor, ZUMK-Engineering. This included handling cross-border litigation, including bankruptcy proceedings in Russia to include Dekhkanabad Potash Plant's claims in the creditor's register and to hold the management subsidiary liable, as well as related litigation in Uzbekistan concerning the recognition of property rights for constructed facilities and the declaration of the absence of the client's debt to ZUMK-Engineering.
  • Representation of Georgia on the recognition and enforcement of a Paris-seated arbitral award in Kazakhstan, obtaining exequatur from state courts contrary to the long-standing judicial practice of refusing such actions against foreign debtors, and securing the first-ever recognition and enforcement of a foreign arbitral award by the AIFC Court.
  • Representation of the Ministry of Justice of the Republic of Kazakhstan in the Kazakh-Turkish joint venture company, F&A Road Construction, related to the significant road reconstruction of Kurty-Burylbaital highway in Kazakhstan under the ICC Rules.
  • Representation of one of the leading European industrial group specialised in the construction and civil engineering business on, and providing assistance with, the contract and claim management, review of negotiation position papers, as well as strategic issues in relation to the construction of the dam in the CIS region.
